Mental illnes can affect many of us to some extent during our lives, some to the extent that they commit crimes and some to a lesser extent. I don't think anyone 'get's away with it' just because they SAY they are insane, it has to be proved to be so by the authorities.  |

if you look at some cases, im not sure which you see they said they were insiane and they got past the exam, they were declaired insane... eventually they got out and did it again! How insane is that person if they commit a crime more than once...  |

well, in some cases the killer or what have you is actually crazy! but in some cases they are using that defense as an easy way out. i think they need to be proven insane by better standards, so no one can fake it!  |

If they are indeed insane and not just temporarily mentally ill then they should not be let back out but cared for in a suitable establishment, however, if they can be treated then they should be released back into the community after a reasonable spell in a secure hospital.  |

The insanity is there for a reason and peopel are insane. Some people claim insanity arent but they could be in a state of tempory insanity. Yes, its a good thing to have in the court system because insane people do exist. If they are insane they got locked up in a mental asyslum. Like other people that comment on prisoners have it good - we are on the outside looking in. We dont know what really goes on in the asylum. Ever hear stories about orderlies beating the insane people. Im sure life isnt all good in the asyslum.  |

OK, I presume you think you are a reasonably stable human being, what if you became mentally ill for some reason or other and comitted a crime such as murder. After treatment you were once again stable, you had no recollection of having comitted a crime......what would you feel like if you were improsoned for the rest of your life?  |

The true spirit of that defense is good...meaning that those who truely are insane and not aware/in control of their actions do need to be institutionalized to get the help they need, unlike those who are just trying to dodge the big house with the "insanity plea".  |

So, to take away the insanity defense you really wouldn't be being all that fair to the poor shmoe who's got paranoid schizophrenia and the government won't buy him any medication because he doesn't have a job and can't get one 'cause he's insane!  |

Not Guilty by Reason of Insanity is an important tool in our legal system. It simply isn't humane to throw a truly mentally ill person into prison for committing an act that they truly cannot be held responsible for. When discussing this topic one should keep in mind that people found NGRI are NOT found innocent of their crime, they are found guilty and usually bound over to some type of facility until they are deemed "sane". This often never happens so in all likelyhood a person found NGRI of murder would spend more time incarcerated than the person simply found guilty. When you are found just guilty of a crime you are give a specific sentence to be completed often along with the possiiblity of parole. Because people found NGRI are not mentally stable, they aren't sentenced to a facility for a certain amount of time, they are to stay there until they are deemed no longer a threat to themselves or others, often that is never. While I believe that people should pay for the crimes that they commit, I also strongly feel that you cannot hold a severly mentally ill person responsible for their actions in these cases. And another point to keep in mind, NGRI pleas rarely are successful. I believe the statistics are that this defense is used in 9 out of every 1000 cases and successful in only 25% of these cases. The criteria for this defense is difficult to meet and generally rules out your run of the mill psychopath. The insanity defense bases itself upon the idea that the defendent has a severe mental disorder or defect and the defendent was not able to appereciate the nature or quality of the wrongfulness of his or her acts. |

It's disgusting. "Not Guilty by reason of insanity" should not even exist in our system. Just because you are "insane" does not make you innocent if, in fact, you carried out the same crime that a sane person did, just for different reasons. If you're commit a crime, sane or not, you deserve to be punished and removed from society.  |
