I think it is crazy! Because if they are really insane they should be locked in a Mental Home for life if they murder which is usually the case anyways. |

it shouldn't matter if they're mentally insane or clincally retarded, they should be treated as the criminal they are. |

I don't agree with it. I think that the insane defense is definitely overused. There are many that get by with murder because they claim insanity. I think it's bull. |

I actually agree with you. Eventually it'll get to the point that the criminals that are truly are insane will get punishment, and the ones that aren't and just use it as an excuse are the ones that get off the hook. It doesn't make sense, it never did, and it probably never will. |

For a criminal to plead insanity is insane...to many criminals seem to use that to defend their actions. If by chance a criminal is insane then they need to be in a mental hospital instead of a prison. |

Very few are insane. Its just a way for them to get off easily. Temporqary insanity. what a laugh!!! The true insane are the ones like the woman who drowned her kids in Texas. Or serial killer. Not someone who shot someone in a fit of jealousy or rage. They knew what they were doing and all I gotta say is they will have to answer to thier own God when that time comes. |

Uh... I guess they can plea it, but even if they are insane or not there is no reason too keep them alive. What good is it going to do to keep an insane murderer alive? All it is is more taxes people have to pay; and risking more deaths if they attempt to kill a gaurd or another prisoner. |

It is such a cop out! Besides, if you're insane, you need to be locked up simply for admitting it. But it still doesn't excuse a crime in my opinion. |

I think anyone who murders or does any other heinous crime IS insane. They shouldn't waste time trying to figure out if they are. Of course they are, people in their right minds don't do these things. The question is how insane are they, and should they be in jail or a mental institute. Either way they should not be let out earlier because they end up in an institute. The majority of these supposed "reformed" mental patients get out only to strike again. Of course they appear to be better, they're in a controlled environment. Once they get out among society they revert back to their old "habits". They need a controlled environment to cope. |

For most of them, I think it's just a way out. Some of them probably are insane, but they should still be punished in some way. |
