Help~Taxes!! *updated*

I posted this in seriuos advice, but I didnt realize only admins could reply, so Im reposting it here. :)

OK, I need help on my taxes! Me and my hunny have been together for 4 years. We arent legally married, but we represent ourselves as husband and wife. We have never filed our taxes together before and I didnt work this year, so Im confused. Since we arent legally married are we not allowed to file jointly? Or should he just claim me as a dependant?

I filled out 1040 form both ways, and if we filed married, we'd get more money back, which will go towards a down payment on a house. but I dont want to get in trouble if it illegal to file married even though your really not married.

sorry if this is confusing, im confused too LOL Any advice would be appreciated, Thanks in advance :)

I went to H&R block.com, and they wanted me to pay $19.95 just to ask a question!! Ahhh! And I tried to find something about this at irs.gov, but no luck.

*update*: Hey guess what you guys! We went to H&R Block to file, and we told the lady our situation and she told us that since we lived together as a couple for the whole year, that we could file as married. I went along with what she said, cause you know H&R block has that insurance thing were if they mess up on something, they will cover your losses...Sooooo, if what she said is infact incorrect, its not our problem lol! So yeah, we ended up filing as married :) Thanks for all your replies! :)

YOu cannot file married if you dont have that little piece of paper... sad but true. Maybe next year yall can be married, hehehehe.. (he will love me for that comment huh?) Good luck!!!

I read once where the IRS dearly HATES it when people do that because they can claim as if they had been married ALL year when in reality they havent, lol... ANYTHING to get back at IRS I am all for.. lol

One word of caution, if you present yourself as married and file taxes as such then legally you ARE. In other words if you split you have to file for divorce.

BCAR, the only thing not making us 'commonlaw' is the little paper from the county clerk saying we are...but, when we bought our car last month, they made us both sign the title, and they made me sign using his last name, i didnt mind, but does that constitute commonlaw marriage too?

Date: 2/11/2004 8:41:00 AM  From Authorid: 42519    Common law marriage is acutally recognized in a handful of states. You live in a state that recognizes common law marriages. To qualify as a common law, you need to refer to yourself as "Husband and Wife", live together for a substantial amout of time, and some other thing I cant remember. I believe it is SUPPOSED to be 7 years together. I have so many people telling me I am full of myself, but I think it is 7 years. Legally, you can not file jointly, and he can claim you as a dependant ONLY if you made NO money last year. If you have, you have to file seperately. Its the way it is. I find most of my questions on GOOGLE, but I also have found www.irs.gov/faqs/faq-kw129.html was really helpful as well.
