Eminent Domain (<>..<>)

If you don’t know what eminent domain is, it’s when a government has the power to take over private property for public use. This can include taking land for roads, airports, and other projects cities have in mind. The private property owner and the city, state, or federal government makes a negation with them to compensate pay for the land (included in the 5th amendment). Eminent domain is seen more and more as population and cities grow larger.

Though eminent domain is usually for public use, it’s not limited to seizure for private ownership. I’ve heard of a number of both homesteads and other business’s land being eyed by cities to hand over to other businesses in the name of “the public’s best interest”. I actually saw a show where a man who owned an automotive shop and was threatened with eminent domain in order for a hardware store to expand. [< A court did eventually rule against it in that case.] In some cases cities have legislated strict codes in order to declare residential areas “blighted” in order to be able to condemn land so apartments can be built there. The people who run the city like it because the city gets more money with higher property taxes, developers like it because of obvious reasons, and the losers are the people who are just about forced out of their property.

It can clearly be seen how greedy government bodies can be sometimes when they seize churches, which are exempt from forms of taxation. They aren’t wanted because they don’t bring a whole lot of money in. City councils claim churches are “not the best use of land”, but I personally think a community could get better use out of a church then a private business going in place of it.

In Texas, where I live I’ve seen this happen to many farms when they were annexed by the city. Where there used to be fields and trees there is now a trailer park. Obviously people are going to want to start businesses, but I find it disturbing when they hook up with the government and have their eye on forcing people out of private property. Eminent domain abuse has become such a problem there are citizens organizations formed and a number of libertarian lawyers taking on eminent domain cases.

Not too long ago someone stopped by my house and my neighbors because they wanted to build a road through there to the B&B. Of course we flat out said no but who knows what'll happen.

I understand what you mean though, my parents own a lot of property around various places and have had to face putting fire hydrants on the land and people wanting roads built through it also.

During WW2, The U.S. Governement confiscated land from the native american's under an act that allowed the governement to claim land for "War" purposes. You may be familiar with this military base...it's Fort Hood. What they tried to keep under raps is that the land that they were building on was ancient indian Burial ground & they were removing the bones from the burial sites & Not reporting it to the native american tribal government. One bar on the outskirts of Fort hood hand a skeletal remain under glass as a "Tourist" attraction. When Tribal government caught wind of this there was a big stink & then the government made a Gravesite on base for the Remains to be put.

Now they are fining him for everything that they can get him for. A piece of wood in his yard, Garage needed a spec of paint,etc. He is still paying fines. It's not right.

Few People out there who own their own homes with a city street or county road in front realize that the 20-50 ft next to the road may belong to them but the City/ County/ State has the right to do anything they want with it. So everyone is affected. The whole thing is of course so the needs of the many can't be blocked by an individual, but it gets abused. You ARE however entitled to fair compensation for your land.

Often they will bring outside council with no affiliation to the town to decide where highways need to go, but I don't think the city should have any say about private property going to another private business. That's the government playing favorites with who ever will bring in the most taxes and revenue towards the city. And I suppose after you sold that 20-55 feet of land they could come back later and try to get the rest of it. That's one of the reason's we have our house so far away from the road.
