you should be able to get your money back. file a complaint against the seller with ebay. you'll have to either call or email customer service.  |

i just talked to her.
she said she lost it and then bought a new one and sold me the one that she lost. i bet she put a claim out that she lost it so that's why its coming up stolen.hopefully she can drop that claim so i can use it.  |

I hope she can get the claim changed. Unfortunately, she might have to pay a fine to the wireless company, so you might want to file a complaint with Ebay now so you don't lose out in case she decides not to file the claim.  |

yeah, i mean, i dont think she would have stolen it. i have talked to her on the phone several times and emailed her and we are friends on facebook so i really dont think that if she was trying to scam me she would continue to talk to me. |

Any time you buy a phone from E bay or any such business, be sure to get the ESN/MEID or Hex/DEC first before buying. Call the carrier and have the number checked against the lost/stolen and negative list. If a phone is on an account that has been written off due to non payment as well, Verizon won't activate it. Sorry to hear this happened to you. Unfortunately it's common. If it's an insurance replacement, the insurance company will have been the one to list it lost/stolen. I work for Verizon so run across this frequently. Good luck :)  |

Now I can't tell if she's lying or not.
I mean I didn't think she would go through the trouble of adding me on facebook and stuff and still talking to me if it was fraud, but it didn't come in a box or with a charger and that seemed a little odd to me...good thing I was smart enough to use pay pal. |

Yeah I love it too.

UPDATE: The seller said she got it from her friend who gave it to her. She said she tried to call verizon and they said it was stolen and she had no idea...she said she was really sorry and she's sending me a check in the mail. |
